Introduction
Calcutta that is Kolkata is our Home. We are Advocates registered with the Hon'ble High Court at Calcutta. Calcutta, currently the capital city of the State of West Bengal within the "Sovereign Socialist Secular Democratic Republic" Union of States - India that is Bharat, is situated at the eastern extremity of the vast, flat Indo - Gangetic plain, which extends over 2400 Kms from the Punjab in the West to West Bengal in the east. It is sited 32 Kms upstream from where the Hooghly River flows in to the Bay of Bengal.
In 1773, Calcutta was made the pre - eminent English possession in India allowing the Governor - General of India; appointed by the Prime Minister of England, for a sort of general control over other British possessions in India. Calcutta continued to be the Capital City of Indian Empire till the 12th day of December, 1911.
Being the only metropolis in Eastern India, Calcutta a city of more than 10 million people, cashes in on the huge resources available in West Bengal and its neighboring states and hinterlands.
High Court at Calcutta is a letter patent High Court and amongst the oldest in India. The Report of the Committee of Secrecy of the year 1773 formed the basis of Regulating Act (13 Geo iii.c. 63) that empowered His majesty to establish a Supreme Court at Calcutta which was accordingly formed and constituted by the charter of 26th March, 1774. And it was the Supreme Court of judicature at Fort William.
Upon assumption of direct responsibility of government by the Crown replacing the East India Company, as a policy decision, Supreme Court was abolished and High Court of judicature was brought in to existence to become supreme over all the Courts both in the presidency town as well as in the mofussil. The Act 24 and 25 PICT., C 104 was speedily passed empowering the Crown to establish a High Court for Bengal Division. Thereupon, however the Charters were issued in 1862 and subsequently new Charters in 1865 under which the High Courts at Bengal, Madras and Bombay were constituted.
After the Independence, The Constitution of India has empowered the High Courts, apart from authority of superintendence over all Courts and Tribunals through out the territories in relation to which it exercises jurisdiction, to issue Writs in the nature of habeas corpus, mandamus, prohibition, quo warranto and Certiorari to any person or authority, including in appropriate cases, any Government for enforcement of any of the fundamental rights guaranteed under The Constitution of India and for any other purpose.
The letters patent have been held to be constitutionally valid and in force within the meaning of Article 372 read with Article 225 of the Constitution of India. Under superintendence of the Hon'ble High Court at Calcutta, for the City of Calcutta there are Courts; City Civil Court, City Session Court, Presidency Small Causes Court, Chief Metropolitan Magistrate's Court etc. Further there are Tribunals separately for Service, Laborers, Debts Recovery etc. and Fora like Consumers fora. One Debts Recovery Appellate Tribunal is located at Calcutta being the Appellate Authority for all the Debts Recovery Tribunals of all the States in the Eastern Region. |
